SUMMARY: The National Parks Omnibus Management Act of 1998 encourages the sale of authentic United States Indian, Alaska Native, Native Samoan and Native Hawaiian handicrafts relating to the cultural, historical, and geographic characteristics of units of the national park system. This final rule implements the requirements of the act.

Federal Plan for Certification of Restricted Use Pesticide Applicators in Navajo Indian Country; Notice of Implementation; and Announcement of Availability of Form to Request Pesticide Applicator Certification in Navajo Indian Country

SUMMARY: In the Federal Register of February 3, 2006, EPA issued the notice of intent to implement a federal program to certify applicators of restricted use pesticides (RUPs) in Navajo Indian Country. The program will be implemented by EPA Region 9, located in San Francisco, CA. In the notice, EPA solicited comments from the public on EPA's intent to implement a federal certification plan in Navajo Indian Country and on its proposed Federal Plan for Certification of Restricted Use Pesticides in Navajo Indian Country (federal plan). No comments were received and EPA hereby implements the federal plan. Applicators who currently purchase and/or apply RUPs in Navajo Indian Country will have until October 11, 2007 to become certified by EPA. After that date, applicators of RUPs must hold the appropriate EPA certification to purchase and/or apply in Navajo Indian Country. Failure to hold the appropriate certification after October 11, 2007 may result in federal enforcement action in accordance with section 12(a)(2)(F) of FIFRA. This notice also serves to announce the form (EPA Form 8500-17-N) EPA will use for pesticide applicators seeking certification in Navajo Indian Country. Pesticide applicators seeking certification to use RUPs in Navajo Indian Country must complete this form and submit it to EPA Region 9 at the location listed under ADDRESSES.

Migratory Bird Permits; Religious or Spiritual Use of Feathers by Native Americans

SUMMARY: The U.S. Fish and Wildlife Service is considering amending its migratory bird regulations to allow Native Americans to acquire parts and feathers from birds other than eagles for religious or spiritual use. No current regulations govern the acquisition and possession of migratory bird parts and feathers of birds other than eagles for Native American religious or spiritual use. We have a compelling interest in protecting the traditional religious and spiritual resource values of Native Americans as part of our trust relationship with federally recognized Native American tribes. We recognize the need to balance this compelling reason against the equally compelling basis for the Migratory Bird Treaty Act. We seek information necessary to prepare an environmental assessment under the National Environmental Policy Act and its implementing regulations for a possible proposed rule.

AGENCY: National Park Service, Interior.
ACTION: Notice.

    Notice is here given in accordance with the Native American Graves
Protection and Repatriation Act (NAGPRA), 25 U.S.C. 3003, of the
completion of an inventory of human remains in the possession of the
American Museum of Natural History, New York, NY. The human remains
were collected from King County, WA.
    This notice is published as part of the National Park Service's
administrative responsibilities under NAGPRA, 25 U.S.C. 3003 (d)(3).
The determinations in this notice are the sole responsibility of the
museum, institution, or Federal agency that has control of the Native
American human remains. The National Park Service is not responsible
for the determinations in this notice.
    A detailed assessment of the human remains was made by the American
Museum of Natural History professional staff in consultation with
representatives of the Puyallup Tribe of the Puyallup Reservation,
Washington.
    In 1899, human remains representing a minimum of one individual
were collected from the surface of Burton, King County, WA, by Harlan
I. Smith. Mr. Smith was a member of the Jesup North Pacific Expedition
that was sponsored by the American Museum of Natural History. No known
individual was identified. No associated funerary objects are present.
    The individual has been identified as Native American based on the
presence of cranial reshaping. A bioarcheologist who examined the human
remains estimated them to be of a recent age. Geographic location is
consistent with the traditional and post-contact territory of the
S'Homamish people, who were incorporated into the Puyallup Tribe of the
Puyallup Reservation, Washington in 1854.
    Officials of the American Museum of Natural History have determined
that, pursuant to 25 U.S.C. 3001 (9-10), the human remains described
above represent the physical remains of one individual of Native
American ancestry. Officials of the American Museum of Natural History
also have determined that, pursuant to 25 U.S.C. 3001 (2), there is a
relationship of shared group identity that can be reasonably traced
between the Native American human remains and the Puyallup Tribe of the
Puyallup Reservation, Washington.
    Representatives of any other Indian tribe that believes itself to
be culturally affiliated with the human remains should contact Nell
Murphy, Director of Cultural Resources, American Museum of Natural
History, Central Park West at 79th Street, New York, NY 10024-5192,
telephone (212) 769-5837, before July 23, 2007. Repatriation of the
human remains to the Puyallup Tribe of the Puyallup Reservation,
Washington may proceed after that date if no additional claimants come
forward.
    The American Museum of Natural History is responsible for notifying
the Puyallup Tribe of the Puyallup Reservation, Washington that this
notice has been published.
